1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Player," "User," or "you") and phearn ("phearn," "we," "us," or "our") governing your access to and use of the phearn online casino platform, including all games, features, promotions, and services available at phearn.app and any associated mobile applications (collectively, the "Platform").

By accessing the Platform, creating a phearn account, making a deposit, or placing any wager, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, together with phearn's Privacy Policy and any game-specific rules or promotional terms published on the Platform.

2.4 One Account Policy

Each individual may register and maintain only one (1) phearn account. The creation of multiple accounts by the same individual — whether using different email addresses, mobile numbers, or payment methods — is strictly prohibited. phearn employs technical and manual verification measures to detect duplicate accounts. Where duplicate accounts are identified, phearn reserves the right to close all associated accounts and forfeit any balances therein.

3. Account Security and Responsibilities

You are solely responsible for maintaining the confidentiality of your phearn account credentials, including your username, password, and any two-factor authentication codes. You agree to:

• Choose a strong, unique password and not share it with any third party;
• Log out of your account after each session, particularly on shared or public devices;
• Notify phearn support immediately if you suspect unauthorized access to your account;
• Not allow any other person to access or use your phearn account on your behalf.

phearn will never ask for your password via email, SMS, live chat, or any other communication channel. Any such request should be treated as a phishing attempt and reported to phearn support immediately.

phearn shall not be liable for any loss or damage arising from your failure to comply with these security obligations. All transactions completed using your account credentials will be deemed to have been authorized by you unless you have previously notified phearn of a security breach.

4. Deposits, Withdrawals, and Payments

4.1 Accepted Payment Methods

phearn accepts deposits and processes withdrawals via the following payment methods available to Philippine players: GCash, PayMaya / Maya, bank transfer (including BPI, BDO, Metrobank, UnionBank, Landbank, PNB, and Security Bank), and debit card. All transactions are denominated in Philippine Peso (₱).

4.2 Deposit Conditions

All deposits must be made from payment accounts registered in your own name. phearn does not accept deposits from third-party accounts. Minimum and maximum deposit amounts are specified on the cashier page and may vary by payment method. phearn reserves the right to refuse or reverse any deposit that cannot be verified or that is suspected to be fraudulent.

4.3 Withdrawal Conditions

Withdrawals are subject to identity verification (KYC). phearn will not process any withdrawal until the player's identity has been verified to phearn's satisfaction. Withdrawal requests are processed within the timeframes specified on the cashier page, which vary by payment method. phearn reserves the right to request additional documentation before processing any withdrawal.

4.4 Currency

All account balances, deposits, wagers, winnings, and withdrawals on phearn are denominated in Philippine Peso (₱). phearn does not accept or process transactions in any foreign currency or any form of cryptocurrency.

5. Bonuses and Promotions

phearn offers various bonuses and promotions to eligible players, including welcome bonuses, reload bonuses, free spins, and loyalty rewards. All bonuses are subject to the following general conditions, as well as any specific terms published alongside each promotion:

• Bonuses are credited to a separate bonus wallet and are subject to wagering requirements before any associated winnings may be withdrawn;

6. Gameplay Rules and Fair Use

In the event of a discrepancy between a game result displayed on your device and the result recorded on phearn's servers, the server-side record shall be deemed authoritative.

9. Intellectual Property

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for personal, non-commercial entertainment purposes.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the phearn Platform without phearn's prior written consent. Any unauthorized use of phearn's intellectual property may result in account termination and legal action.

10. Limitation of Liability

To the fullest extent permitted by applicable law, phearn shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform, including but not limited to:

• Loss of winnings due to technical malfunction, server downtime, or connectivity issues;
• Unauthorized access to your account resulting from your failure to maintain account security;
• Any decision made by you in reliance on information published on the Platform;
• Interruption or cessation of the Platform for maintenance, upgrades, or regulatory compliance.

phearn's total aggregate liability to you for any claim arising under these Terms shall not exceed the total amount deposited by you into your phearn account in the thirty (30) days preceding the event giving rise to the claim.

The Platform is provided on an "as is" and "as available" basis. phearn makes no warranties, express or implied, regarding the Platform's fitness for a particular purpose, uninterrupted availability, or freedom from errors.

11. Suspension and Termination

phearn reserves the right to suspend, restrict, or permanently close any player account at its sole discretion, with or without prior notice, in the following circumstances:

• Breach of any provision of these Terms;
• Failure to complete identity verification within the required timeframe;
• Suspected fraudulent, illegal, or abusive activity;
• Receipt of a self-exclusion request from the account holder;
• Regulatory requirement or direction from a competent authority;
• Extended account inactivity (accounts inactive for 12 consecutive months may be classified as dormant).

Upon termination of your account for cause, phearn reserves the right to forfeit any remaining balance. Where an account is closed at the player's request and no breach has occurred, any verified real-money balance will be returned to the player via their registered payment method, subject to completion of any outstanding wagering requirements on bonus funds.

12. Amendments to These Terms

phearn reserves the right to amend these Terms at any time. Where changes are material, phearn will provide reasonable notice via email to your registered address or via a prominent notice on the Platform prior to the changes taking effect. Your continued use of the Platform after the effective date of any amendment constitutes your acceptance of the revised Terms.

13. Governing Law and Disputes

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

In the event of a dispute between you and phearn, you agree to first contact phearn's customer support team to seek an informal resolution. If the dispute cannot be resolved informally within thirty (30) days, either party may refer the matter to the appropriate regulatory authority or competent courts of the Philippines.

Nothing in this clause shall limit phearn's right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement of its intellectual property rights or to address any prohibited conduct described in Section 7.
